These Terms of Service (“Terms”) govern your use of our website and AI services located at https://incluud.com (“Site” and “Services”). By accessing or using our Site and Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services. 

  1. Use of the Site and Services  

You agree to use our Site and AI services only for lawful purposes and in accordance with these Terms. You must not: 

– Use the AI technology or content in any way that violates applicable laws or regulations. 

– Attempt to reverse engineer, decompile, or tamper with our AI models or infrastructure. 

– Use the AI services to create or distribute harmful, malicious, or illegal content. 

– Use the services in a manner that could damage, disable, or impair the functionality of the Site or services. 

  1. Intellectual Property  

All content, including AI models, algorithms, trademarks, logos, and proprietary information, is owned by Incluud, Inc. or its licensors. You agree not to copy, modify, reproduce, or create derivative works without our prior written permission. 

  1. User Data and Privacy  

Our AI services may process data provided by you. Our use and handling of your data are governed by our Privacy Policy available at https://ps-gokit.incluud.com. You warrant that any data you provide complies with applicable privacy laws and that you have the necessary rights to use it. 

  1. AI Output and Limitations  

Our AI models generate outputs based on input data; however, we do not guarantee accuracy, completeness, or reliability of the AI-generated content. Use of the outputs is at your own risk. We disclaim liability for any damages resulting from reliance on AI outputs. 

 

  1. API and Usage Restrictions  

If using our APIs, you agree to adhere to any usage limits, quotas, and policies outlined in our API documentation. You shall not attempt to bypass restrictions or access data beyond authorized levels. 

  1. Termination and Suspension  

We may suspend or terminate your access to the Site or AI services at any time without notice for violations of these Terms or for other reasons we deem appropriate. 

  1. Limitation of Liability  

To the maximum extent permitted by law, Incluud, Inc. shall not be liable for any damages arising from the use or inability to use our AI technology or services, including but not limited to errors, omissions, or inaccuracies in AI outputs. 

  1. Changes to the Terms  

We reserve the right to update these Terms at any time. Changes will be posted on this page and are effective immediately upon posting. Continued use indicates acceptance of those changes. 

  1. Governing Law  

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
